<p>Our client held a large archive of municipal documents at their headquarters. They were moving to a purpose-built new office, designed with an open planned office in mind, but limited on storage space for large volumes of documents. This made it clear that a new approach to storing their records was needed before the move could take place.</p>



<h2 class="wp-block-heading">The challenge</h2>



<p>Municipal documents often come with long retention periods and strict handling rules. This meant our client&#8217;s request had a few specific requirements to meet.</p>



<p><strong>ISO accredited provider: </strong>The client&#8217;s policy is to work with an ISO accredited supplier, giving them confidence that their records would be handled and stored to a recognised standard.</p>



<p><strong>Tight deadline</strong>: With the office move fast approaching, our client needed the archive indexed, secured and transported quickly. The timeline was short, but security still had to come first.&nbsp;</p>



<p><strong>Controlled access by department: </strong>The archive held records from several different departments, each with its own security and access levels. Our client needed a way to keep these records separate, so that each employee could only access information relevant to their own department.&nbsp;</p>



<p><strong>Quick retrieval:</strong> Once everything was in storage, the client still needed to reach their records at short notice.</p>

<p>Firstly, the client indexed the boxes and prepared them for collection. We then booked a convenient time to collect them using secure, GPS tracked vans driven by DBS checked staff.</p>



<p>Once the records arrived at our secure facilities, each box was barcoded and referenced on our system, so that data provided by the client could be implemented into our database. We then separated the boxes into departments and assigned access to named contacts for each one, helping the client stay compliant with data protection laws.</p>



<p>Going forward, nominated staff can now make requests through our client portal and receive their items the next day. This cuts out the need to search through an archive manually and frees up time for other valuable work.</p>



<p>We also arranged transport and storage for the large, bulky items that were awkward for the client to store.</p>



<h2 class="wp-block-heading">The result</h2>



<p>Our client&#8217;s archive is now stored safely in our secure facilities, with every record indexed on our client portal. This gives them a full audit trail, so they can see exactly where each document is and who has accessed it.</p>



<p>Access to the archive is restricted to named staff for each department. This has improved data security and helped the client stay compliant with data protection regulations, without slowing down day to day work.</p>



<p>Staff can request records through the portal and receive them the next day, so information is never far out of reach. This has cut the time spent searching for physical files and freed up staff to focus on other tasks.</p>



<p>The bulky and irregular items that once caused storage headaches are now kept safely in our warehouse. These can be retrieved easily, without the manual handling risks the client faced before.</p>

<p>On 1st May 2026, the Renters’ Rights Act 2025 came into force, marking the most significant reform of England’s private rented sector in a generation. The Act fundamentally reshapes how tenancies are structured, how possession can be recovered, how rents are increased, and how landlords and agents must demonstrate compliance.</p>



<p>For landlords, letting agents and property professionals, this is a practical challenge too. Keeping the right paperwork, storing it properly and being ready to evidence decisions will be key to staying compliant and handling any disputes that could arise.</p>



<p>Our article provides an overview of the key reforms, and highlights the records and their retention requirements.</p>



<h2 class="wp-block-heading"><strong>A new tenancy framework: the removal of fixed terms and Section 21</strong></h2>



<p>From 1st May 2026:</p>



<ul class="wp-block-list">
<li>Assured Shorthold Tenancies (ASTs) were abolished.</li>



<li>All private tenancies became open-ended assured periodic tenancies.</li>



<li>Section 21 “no-fault” evictions ended for the private rented sector.</li>
</ul>



<p>Landlords can no longer rely on tenancy expiry to regain possession. Instead, possession must be sought using specific Section 8 statutory grounds, such as rent arrears, serious anti-social behaviour, selling the property, or moving in themselves.&nbsp;</p>



<p>Landlords must be able&nbsp; to prove their reason for possession and poor record keeping will significantly weaken claims. Evidence of rent arrears, sale instructions, or occupation intentions should all be accurately retained.&nbsp;</p>



<h2 class="wp-block-heading"><strong>Rent increases: the int</strong>roduction of a formal process<strong>&nbsp;</strong></h2>



<p>The Act introduces a single lawful method of increasing rent, giving tenants enhanced rights to challenge excessive or above-market rent increases.</p>

<li>Rent can only be increased once per year.</li>

<p>Copies of Section 13 notices, comparable market evidence supporting the rent level and any tenant correspondence or tribunal outcomes should be retained. These records may be required months or years later if a rent increase is disputed.</p>



<h2 class="wp-block-heading"><strong>Mandatory tenant information: the information sheet deadline</strong></h2>



<p>For existing tenancies created before 1st May 2026, landlords (or managing agents) must provide the official Renters’ Rights Act Information Sheet 2026 to every named tenant by 31st May 2026.&nbsp;</p>



<p>The <a href="https://www.gov.uk/government/publications/the-renters-rights-act-information-sheet-2026" rel="nofollow">exact document</a> from GOV.UK must be used and it must be issued as a hard copy or PDF attachment. Failure to comply with this can result in fines of up to £7,000.</p>



<p>Landlords should retain proof of issue (email logs, read receipts, postal certificates), a copy of the exact version provided and a record showing which tenants received it and when. These records will be essential if enforcement action is taken in order to prove the information sheet was issued.</p>



<h2 class="wp-block-heading"><strong>Restrictions on rent in advance, advertising, and discrimination</strong></h2>



<p>The Act introduces a number of behavioural prohibitions aimed at protecting tenants, including a ban on rental bidding wars by preventing landlords from accepting offers above the advertised rent. It also caps rent paid in advance at no more than one month and makes it unlawful for landlords to refuse prospective tenants solely because they have children or receive benefits.<br><br>Letting agents and landlords should retain these records should they be required by the local authority, or in future, the Private Rented Sector Ombudsman:</p>



<ul class="wp-block-list">
<li>Property listings and advertised prices.</li>



<li>Tenant selection decision logs.</li>



<li>Objective affordability criteria.</li>



<li>Notes showing non-discriminatory decision-making.</li>
</ul>



<h2 class="wp-block-heading"><strong>Pets, repairs, and property standards: evidence over assumptions</strong></h2>



<p>Tenants gain a statutory right to request a pet, which landlords must consider reasonably. Future phases of the Act will also extend Awaab’s Law and the Decent Homes Standard into the private rented sector, which will significantly raise property condition standards. Awaab’s Law is a UK housing law designed to protect tenants from dangerous living conditions like damp and mould. Whereas the Decent Homes Standard is a broader government benchmark that sets out the minimum quality a rented home must meet</p>

<p>The Employment Rights Act 2025 (“ERA 2025”) is the most far-reaching reform of employment law in decades. Receiving Royal Assent on 18 December 2025, the Act forms part of the government’s <em>Make Work Pay</em> agenda and introduces wide-ranging new rights for workers alongside significantly strengthened enforcement powers.&nbsp;</p>



<p>From 2026 onwards, employers face not only new obligations around pay, leave and dismissal, but also a much greater expectation to prove compliance through accurate, accessible and securely stored records. Central to this shift is the introduction of a new regulator: the Fair Work Agency (FWA).</p>



<h2 class="wp-block-heading">What is the Employment Rights Act 2025?</h2>



<p>The ERA 2025 introduces more than<strong> </strong>28 reforms<strong>,</strong> reshaping employment practices across the entire employee lifecycle. Its objectives include:&nbsp;</p>



<ul class="wp-block-list">
<li>Enhancing job security</li>



<li>Strengthening worker protections</li>



<li>Increasing transparency and accountability</li>



<li>Improving enforcement of employment rights</li>
</ul>



<p>The legislation applies across England, Wales and Scotland, with changes being implemented progressively through 2026 and 2027.&nbsp;</p>



<h2 class="wp-block-heading">Key changes employers should be aware of</h2>



<p><strong>Day-one rights</strong></p>



<p>From April 2026, key UK employment rights take effect from the first day of employment, removing long‑standing qualifying periods and increasing employer obligations.</p>



<p>Employees now qualify for Statutory Sick Pay (SSP) from day one of sickness, with the previous three unpaid waiting days removed and the lower earnings limit removed. This means SSP applies immediately, including for new starters and lower‑paid workers, increasing short‑term absence costs for employers.</p>



<p>In addition, paternity leave and unpaid parental leave become day‑one rights. Employees no longer need 26 weeks’ service for paternity leave or one year’s service for unpaid parental leave. While statutory pay rules largely remain unchanged, the right to take leave now applies from the start of employment.</p>



<p>Overall, these reforms mark a clear move towards immediate workplace protections. Employers must ensure contracts, policies, payroll systems and manager guidance are fully updated, as compliance now starts on day one, not after probation or qualifying service.</p>



<p><strong>Unfair dismissal reform</strong></p>



<p>From 1st January 2027, employees will gain earlier access to ordinary unfair dismissal rights, with the qualifying period reduced from two years to six months. At the same time, the statutory compensation cap will be removed, allowing tribunals to award compensation based on actual losses rather than a fixed limit.</p>



<p>This significantly increases employer exposure, particularly where dismissals occur during early employment or probation. As a result, a robust probation process, a clear and well explained reason for dismissal, and accurate record keeping will be essential from the first six months of employment, rather than something employers can rely on later in the employment relationship.</p>



<p><strong>Fire and rehire restrictions</strong></p>



<p>Fire and rehire is the practice of dismissing employees and re‑employing them on new, often less favourable, terms. From 1st January 2027, the Employment Rights Act 2025 will introduce stronger protections to address unfair use of this practice, increasing protection for employees. For employers, this raises the legal and financial risk of unfair dismissal claims where dismissal is used to force contractual change without proper consultation or justification.</p>



<p><strong>Collective redundancy penalties</strong></p>



<p>Failure to consult correctly on collective redundancies may now result in penalties of up to 180 days’ pay per affected employee, which is double the previous maximum. This significantly increases financial risk for employers and underlines the importance of early, meaningful consultation and strict compliance with collective consultation rules.</p>



<h2 class="wp-block-heading">The Fair Work Agency&nbsp;</h2>



<p>The Fair Work Agency (FWA) was formally launched on 7th April 2026 as an Executive Agency of the Department for Business and Trade. It replaces and consolidates several existing enforcement bodies, including:&nbsp;</p>



<ul class="wp-block-list">
<li>HMRC’s National Minimum Wage Unit</li>



<li>The Gangmasters and Labour Abuse Authority</li>



<li>The Employment Agency Standards Inspectorate</li>



<li>The Office of the Director of Labour Market Enforcement </li>
</ul>



<p>The aim is to create a single, more powerful enforcement body responsible for ensuring compliance with employment law across the UK.</p>



<p><strong>What does the Fair Work Agency enforce?</strong></p>



<p>The Fair Work Agency (FWA) is responsible for enforcing a broad range of labour market protections. This includes ensuring compliance with the National Minimum and Living Wage, Statutory Sick Pay and holiday entitlement including holiday pay. It also includes employment agency regulations, safeguards against labour exploitation and modern slavery, as well as overseeing financial penalties issued by employment tribunals.</p>



<p>Importantly, the introduction of state enforcement for holiday pay and holiday record‑keeping marks a major change for employers, bringing these obligations under direct regulatory scrutiny for the first time.</p>



<p><strong>Enforcement powers and inspections</strong></p>



<p>The Fair Work Agency has extensive investigative powers, including the ability to:</p>



<ul class="wp-block-list">
<li>Request and seize employment records (contracts, pay data, holiday records)</li>



<li>Conduct unannounced inspections</li>



<li>Enter business premises, including with a warrant where necessary</li>



<li>Issue enforcement and underpayment notices</li>



<li>Initiate civil or criminal proceedings</li>



<li>Recover enforcement costs from non-compliant employers</li>
</ul>



<p>Failure to cooperate or produce required documentation can expose businesses to criminal prosecution and hefty fines.&nbsp;</p>



<h2 class="wp-block-heading">Document retention under the Employment Rights Act 2025</h2>



<p><strong>Mandatory holiday record-keeping</strong></p>



<p>From 6 April 2026, employers are legally required to keep adequate records demonstrating compliance with:</p>



<ul class="wp-block-list">
<li>Annual leave entitlement</li>



<li>Holiday pay calculations</li>



<li>Carry-over of leave</li>



<li>Payments in lieu of unused holiday on termination</li>
</ul>



<p>These records must be retained for six years. The Fair Work Agency has explicit responsibility for enforcing these duties and may request records during inspections or investigations.&nbsp;</p>
